Respondent Information Submission

Please be advised that pursuant to state and federal laws, an employer is required to preserve all personnel and other records that may be relevant to the charge until final disposition of the charge. Early resolution by making an Early Offer of Settlement. A written Position Statement fully addressing the charge is not required at this time. However, you must submit a separate written Offer of Settlement to the Commission on or before the assigned date. Should the attempt at Early Settlement fail, a due date for the Position Statement will be scheduled and the case will be remanded to Enforcement.

Participate in a mediation called an Informal Settlement Meeting (ISM). In order to participate in the ISM, you must ensure the presence of a representative with authority to settle the case during the mediation. A written Position Statement fully addressing the allegations of the Charge accompanied by supporting documentation and/or written statements and evidence must be submitted to NERC by uploading to the portal. You will be required to submit your Position Statement no later than seven days prior to the ISM.

Waive participation in the Alternative Dispute Resolution Process. It is understood that selecting this option will cause the case to be remanded to Enforcement. Should mediation be waived, you will be required to submit a Position Statement fully addressing the allegations of the Charge accompanied by supporting documentation and/or written statements and evidence to NERC on or before the specified date.
